CANCELLATION, RESCHEDULING & WITHDRAWAL POLICY

LUKAMOR KINDER PARTY

1. Scope of Application

This policy applies to all contracts concluded with LUKAMOR KINDER PARTY for:

  • Event and party services (including but not limited to planning, coordination, staffing, entertainment, workshops, and on-site execution), and

  • Optional physical products or add-on merchandise ordered in connection with an event.

 

2. Event Services – Legal Classification

2.1 Date-Specific Leisure Services

All event services offered by LUKAMOR KINDER PARTY constitute leisure-related services provided on a specific date or within a defined period, within the meaning of Article 16 (l) of Directive 2011/83/EU.

These services are:

  • Individually planned

  • Capacity-bound

  • Time- and date-exclusive

  • Economically dependent on advance scheduling and resource allocation

 

3. Exclusion of the Right of Withdrawal

3.1 No Statutory Withdrawal Right

There is no statutory right of withdrawal for event services booked with LUKAMOR KINDER PARTY.

The 14-day withdrawal right does not apply.

By concluding the contract, the client expressly acknowledges and agrees that:

  • The service is tied to a specific date

  • The statutory right of withdrawal is excluded

  • Any reference to withdrawal rights applies only to eligible physical goods, not to services

 

4. Client Cancellation of Event Services

4.1 Form Requirement

Cancellations are valid only in written form (email is sufficient).
Verbal cancellations are not accepted.

 

4.2 Cancellation Fees (No Full Refunds)

Due to exclusive date reservation, preparatory work, third-party commitments, and lost business opportunities, the following applies:

  • Cancellation more than 30 calendar days before the event date
    → 50% of the total agreed service fee is non-refundable

  • Cancellation 30 calendar days or less before the event date
    → 100% of the service fee is due and non-refundable

⚠️ Full refunds are excluded in all cases.
This applies irrespective of the reason for cancellation.

 

4.3 Justification of Fees

The agreed cancellation fees represent reasonable compensation for:

  • Planning and administrative services already rendered

  • Reservation of personnel and suppliers

  • Opportunity costs due to blocked availability

  • Business loss caused by late cancellation

The client expressly waives the right to claim disproportionality.

 

5. Rescheduling (Goodwill Only)

5.1 No Entitlement

Rescheduling is not a contractual right.

Any rescheduling is granted solely as an act of goodwill, subject to:

  • Availability

  • Operational feasibility

  • Internal scheduling priorities

 

5.2 Conditions

If rescheduling is granted:

  • It may occur only once

  • The new date must be within a timeframe defined by LUKAMOR KINDER PARTY

  • Additional costs (price increases, staffing, materials, travel) will be charged

If rescheduling is not possible, no refund is due.

 

6. Cancellation by LUKAMOR KINDER PARTY

In the event of cancellation by LUKAMOR KINDER PARTY due to:

  • Force majeure

  • Illness or incapacity

  • Safety or regulatory restrictions

LUKAMOR KINDER PARTY may, at its discretion:

  • Offer an alternative date, or

  • Refund payments already received for the affected service

Further claims (including compensation, damages, or reimbursement of third-party costs) are excluded to the extent permitted by law.

 

7. Optional Merchandise & Add-On Products

7.1 Standard (Non-Customized) Goods

For non-customized physical goods only, the statutory withdrawal right applies:

  • 14 days from receipt of goods

  • Goods must be unused, unopened, and in original condition

  • Return shipping costs are borne by the client

Refunds are processed within 14 days after receipt of returned goods.

 

7.2 Excluded from Withdrawal

The right of withdrawal does not apply to:

  • Customized or personalized items

  • Items produced specifically for a booked event

  • Sealed goods unsuitable for return for hygiene reasons once opened

 

8. Payment & Set-Off

  • Payments already made may be offset against cancellation fees

  • No set-off or retention is permitted unless legally mandatory

  • Chargebacks initiated contrary to this policy constitute breach of contract

 

9. Governing Law & Jurisdiction

  • Governing law: German law

  • Place of jurisdiction: Germany, to the extent legally permissible

  • The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded

 

10. Final Clause

By confirming a booking, the client:

  • Confirms having read and understood this policy

  • Expressly agrees to the exclusion of the right of withdrawal for services

  • Accepts the cancellation and rescheduling terms as binding

I acknowledge that I am booking a date-specific event service and I understand that no statutory right of withdrawal applies and that the cancellation policy is binding.

I accept the cancellation and rescheduling policy.
